Tax Commission to appeal electric car ruling

OKLAHOMA CITY (AP) - The Oklahoma Tax Commission is planning to appeal to the state Supreme Court a ruling on tax credits for electric vehicles that it says could cost the state more than $40 million.

The commission said Wednesday it disagreed with Garfield County District Judge Dennis Hladik’s ruling that any Oklahoma taxpayer who purchased an electric vehicle qualifies for the credit.

Hladik’s ruling was issued in a lawsuit Ada Electric Cars brought against the Tax Commission last month.

The state tax credit is for half the purchase price of an electric vehicle and can be carried over for three years if purchased in 2009.

Marketing campaigns for the low-speed vehicles entice consumers with a practically free car after state and federal tax credits are applied.
